Terms of Service - Arise Above Apps

1. Acceptance of Terms

By downloading, installing, or using any mobile application published by Arise Above Apps ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our apps.

These Terms apply to all Arise Above Apps mobile applications available on the Apple App Store and Google Play Store, including but not limited to AriseFit, AriseMeals, AriseBudget, AriseCredit, Baby Tracker Pro, Home Inventory, AriseMortgage, AriseNetWorth, and all other apps published under the Arise Above Apps developer account.

2. Use of the Apps

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for your personal, non-commercial use on devices you own or control, subject to these Terms and the app-store terms you agreed to when installing.

Restrictions

You agree not to:

Reverse-engineer, decompile, or attempt to extract the source code of the apps
Modify, adapt, or create derivative works from the apps
Use the apps for any illegal purpose or in violation of any applicable law
Transmit viruses, malware, or other harmful code through the apps
Use the apps to harass, abuse, or harm another person

3. Subscriptions and Payments

Certain apps offer optional Pro subscriptions through in-app purchases. The following terms apply to all subscription purchases:

Auto-Renewal

Subscriptions automatically renew at the price shown at the time of purchase unless you cancel at least 24 hours before the end of the current billing period. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Your Subscription

You can manage your subscription and turn off auto-renewal at any time:

iOS / Apple: Settings → [Your Name] → Subscriptions
Android / Google Play: Play Store → Menu → Subscriptions

Refunds

We do not issue refunds for partial subscription periods. Refund requests are handled directly by Apple (via the App Store) or Google (via Google Play) per their respective refund policies. We do not have the ability to issue refunds on their platforms.

Price Changes

We reserve the right to change subscription prices. Any price change will be communicated to you in advance through the app or via the platform, and will take effect at your next billing cycle.

Free Trials

Some subscriptions may offer a free introductory trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price disclosed at the time of sign-up.

4. Disclaimers and No Professional Advice

Our apps are informational and organizational tools only. They are not a substitute for professional advice from a doctor, therapist, attorney, licensed financial advisor, veterinarian, or other qualified professional.

Not Medical Advice

Apps in our health, fitness, wellness, or medical categories (including Baby Tracker Pro, AriseMeds, AriseFit, AriseWeight, AriseWomensHealth, AriseSober, AriseMeditate, AriseVitals, PetHealthPro, and similar) are for tracking and informational purposes only. They are not medical devices and do not diagnose, treat, cure, or prevent any disease or condition. Always consult a qualified healthcare provider.

Not Financial Advice

Apps in our finance, budgeting, or investment categories (including AriseBudget, AriseCredit, AriseDebt, AriseInvest, AriseMortgage, AriseNetWorth, AriseStock, AriseTax, and similar) provide informational calculators and tracking tools. They do not provide investment, tax, or financial advice. Past performance does not guarantee future results. Always consult a licensed financial professional for decisions affecting your finances. Our apps do not execute trades, transfer money, or interact with regulated financial institutions.

Not Legal Advice

Apps that reference legal or regulatory topics are informational only. For legal matters, consult a licensed attorney.

Crisis and Mental Health Support

5. Your Content and Data

Most of our apps store data locally on your device. You retain full ownership of any content you create in the apps. Some apps optionally send data to our servers (for AI features); in those cases, only the specific data you submit is transmitted, never your full app history. See our Privacy Policy for detail on what's collected, when, and why.

You are responsible for backing up content you value. We are not liable for data loss due to device failure, deletion, or uninstallation.

6. Intellectual Property

All app code, design, artwork, content (excluding content you create), and trademarks belong to Arise Above Apps. You may not copy, modify, redistribute, or create derivative works without written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Arise Above Apps, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the apps. Our total cumulative liability for any claim related to the apps shall not exceed the amount you paid in subscription fees during the 12 months preceding the claim, or $50, whichever is greater.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above may not apply to you in full.

8. Termination

We may suspend or terminate your access to the apps at any time for violation of these Terms. You may stop using the apps at any time by uninstalling them. Termination does not relieve you of obligations related to pending subscription payments.

9. Changes to These Terms

We may update these Terms from time to time. The "Effective" date at the top will reflect when changes were made. Continued use of the apps after changes constitutes acceptance of the new Terms. Material changes will be communicated through the app or via email if you've provided one.

10. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Wayne County, Michigan.
